Terms and Conditions

General:

1. Information on how to enter and the prize form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.

Eligibility: 

2. Entry is only open to Australian citizens and permanent residents aged 18 years or older.

Employee Exclusion: 

3. Employees (and their immediate families) of the Promoter and companies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or stepchild, parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.

Promotional Period: 

4. Promotion commences 9:00am on June 1st, 2024, AEST and closes at 3:59pm AEDT on January 23rd, 2025. All times and dates in these Terms and Conditions are in Melbourne time, which may be AEST or AEDT depending on the date.

Promotion Entry: 

5. To be eligible to enter, entrants must purchase during the promotional period, the “Deal or No Deal – Win a Million Edition” board game from Big W and participating outlets, subject to stock availability. Inside each board game is an entry ticket with a unique entry code printed on it (“Code”). A ‘participating retailer’ is any authorised retailer that stocks the “Deal or No Deal” board game, as listed at www.milliondollardeal.com.au.

6. To enter, eligible entrants must, during the Promotional Period;

a. visit www.milliondollardeal.com.au; and

b. complete the promotional entry form with all requested details, and the unique Code; and

c. submit the fully completed entry form.

Prize Draw:

7. The draw will take place at Loyalty.com.au 8/8 Trawalla Avenue, Toorak VIC 3142 on January 27th, 2025. The first valid entry drawn by an independent adjudicator will win $1,000,000 in cash. Two other reserve entries will also be drawn.

Winner and Event Details:

8. The winner will be called after the draw and informed of the following event to take place on February 3rd, 2025. 

9. It is a condition of accepting the prize that the winner agrees to be at home on the specified date to welcome a representative of Deal or No Deal for an interview, photograph, and filming session related to this promotion or a“Deal or No Deal”, to be featured on various media. This interview will be without remuneration and done on a voluntary basis. The cash will be delivered on the day of the event via appropriate security, and measures will be employed by the Promoter to ensure everything is correct and secure. One million dollars in cash will be brought and presented to the winner. The Winner or promoter may choose to have the event at an alternative appropriate venue, to be agreed upon with the promoter.

Total Prize Pool Value: 

10. The total prize pool value is AUD$1,000,000. 

11. The prize is not transferable or exchangeable and will be paid via cash delivery. It will then be taken to the appropriate bank and put into the winner’s bank account, or as defined by the security company, to the winner’s nominated bank account within 14 days of the draw unless otherwise specified.

Purchase Verification: 

12. All entrants are advised that they will be required to provide their receipt of purchase or gift receipt from a participating retailer to confirm their eligibility to win.

Resale Prohibition: 

13. The “Deal or No Deal” board game must not be resold or offered for resale at a premium (including via online auction sites). If a board game is sold in breach of this condition, the Promoter may withdraw the corresponding entry ticket from this promotion, making the purchaser ineligible to win the Prize.

Multiple Entries: 

14. Entrants may enter the promotion multiple times during the Promotion Period, provided that each entry code submitted is unique. The promoter reserves the right to issue bonus codes for the promotion for promotional purposes as they see appropriate.

Proof of Purchase Requirement: 

15. Entrants must retain their original code and a copy of their purchase receipt or gift receipt as proof of purchase. Failure to produce the proof of purchase for an entry when requested may result in invalidation of an entrant’s entry and forfeiture of any right to a prize.

Prize Claim: 

16. In the event the drawn winner fails to claim the prize by the specified date, the reserve entries will be used. Winners will be notified by telephone and in writing via email within two business days of the draw, and their names will be published on www.milliondollardeal.com.au.

Travel for Promotion: 

17. The winner may be asked by the Promoter to travel for the Million Dollar Deal event for the promotion of this competition. At the promoter’s discretion, travel expenses may be covered by the Promoter.

Decision Finality: 

18. The Promoter’s decision is final, and no correspondence will be entered into.

Website Access Costs: 

19. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.

Consent for Use of Information: 

20. Entrants consent to the Promoter using their name, likeness, image, and/or voice in the event they are a winner (including photograph, film, and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), “Deal or No Deal” generally, and promoting any products manufactured, distributed, and/or supplied by the Promoter.

Promotion Interference:

21. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter including but not limited to technical difficulties, unauthorized intervention, or fraud, the Promoter reserve the right, in their discretion, to the fullest extent permitted by law, (a) to disqualify any entrant; or (b) to modify, suspend, terminate, or cancel the promotion, as appropriate, subject to any directions from a regulatory authority.

Liability and Guarantees: 

22. Nothing in these Terms and Conditions limits, excludes, or modifies or purports to limit, exclude, or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter and Sponsor (including their respective officers, employees, and agents) exclude all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.

Responsibility for Loss: 

23. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including their respective officers, employees, and agents), Network Ten Pty Ltd and its related bodies and Endemol Shine Australia (ESA) are not responsible for and exclude all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third-party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of the prize.

Collection of Personal Information: 

24. Entrants’ personal information will be collected by the Promoter and stored on the Promoter’s database. The Promoter may use this information for future marketing purposes and its promotional partners regarding its products, including contacting the entrant electronically. The Promoter will share Entrants’ personal information with Network Ten Pty Limited, its related bodies and Endemol Shine Australia Pty Ltd (ESA), the producer of the television program “Deal Or No Deal”. ESA is bound by the Privacy Act 1988 (Cth) (“Act”) in respect of the personal information it collects and such information will be used in accordance with ESA’s Privacy Policy at http://www.endemolshine.com.au/privacy-policy.  ESA collects Entrants’ personal information for the primary purpose of selecting participants for the production of its programs and may share Entrants’ personal information with its related bodies corporate and broadcast partners, and any of its related companies, associates or affiliates, for this purpose. Entrants’ personal information may be stored by ESA’s third party data storage provider on secure servers located in the European Union, which are accessible by ESA and its parent company, Banijay Group Holding S.A.S. located in France and subject to the data protection safeguards contained in the General Data Protection Regulation (EU) 2016/679. ESA may use Entrants’ personal information to contact them in the future in relation to its programs and/or about other offers and events. Entrants may update or request access to their personal information by emailing [email protected] and including their name, mobile number and an email address in that request.

25. The Promoter is bound by the Australian Privacy Principles in accordance with the Privacy Act 1988 and its privacy policy, which can be viewed at www.milliondollardeal.com.au. Entrants may also opt-in to receive updates from their partners. By opting in, entrants agree that their information will be collected and handled by the promoter and will be subject to the promoter’s privacy policy, which can be viewed at www.milliondollardeal.com.au.
